An urgent hearing is being held at the High Court to challenge a decision by the president of the Legislative Council, Andrew Leung, to allow two Youngspiration legislators-elect to retake their oath of office.

In an unprecedented move, the Chief Executive, CY Leung, and the Secretary for Justice, Rimsky Yuen, initiated the court action on Tuesday against Sixtus Leung and Yau Wai-ching.

It came after Andrew Leung ruled that the oaths taken by Sixtus Leung and Yau, as well as three other lawmakers last Wednesday, were invalid. He said they either changed the wording, or were not solemn enough.

However, Andrew Leung has agreed to let all five have a second chance – so long as they make written requests to be sworn in again.

Both Sixtus Leung and Yau said later that they have written to Andrew Leung seeking permission to retake their oaths.
