Joshua Wong gets bail, Raphael Wong stays in jail

Pro-democracy activist Joshua Wong was granted bail on Tuesday pending an appeal over his three-month jail term for contempt of court.

But Raphael Wong, who was jailed for four-and-a-half months in the same case, was denied bail by the Court of Appeal.

The pair were given the prison terms for blocking court bailiffs sent in to clear the Mong Kok Occupy protest site in 2014.

The two-judge Court of Appeal panel said Joshua Wong, who had pleaded guilty, was granted bail in light of an argument that the trial judge did not consider his young age at the time of sentencing. The activist was 18.

But they refused to bail League of Social Democrats vice-chairman Raphael Wong, saying his grounds for appealing against his conviction were unarguable. He had claimed that the prosecution failed to prove his intent to stay at the protest site and obstruct the clearance operation.

Despite their decision on bail, the judges will hear Raphael Wong's substantive arguments in a hearing on March 5.

Joshua Wong, 21, is also currently appealing against a prison term for storming Civic Square in 2014, as are disqualified lawmaker Nathan Law and former student leader Alex Chow.
