Former RTHK producer Bao Choy was on Friday told she can take her unlawful car licence plate search case to Hong Kong's top court.

Earlier this month, the Court of Appeal upheld Choy's conviction for making false statements when accessing the government's vehicle registration database.

Choy was fined HK$6,000 for the breaches, which took place when she probed the Yuen Long gang attack in 2019.

On Friday, judge Alex Lee granted her leave to appeal to the Court of Final Appeal, citing a point of law of great and general importance that is reasonably arguable.

He said he made changes to the legal question raised, which is on whether the commissioner for transport can reject a search application that has a purpose unrelated to traffic and transport-related matters.

The judge said he set aside another question raised by the appellant because they couldn't reach a consensus on its wording.

Choy said outside court that she is trying to be calm about the case and it is not just about winning or losing, but about perseverance.

"I don't have many worries or get too bothered about the consequences, whether I will win or lose", Choy told reporters.

"I guess what I'm doing is just trying to continue to pursue justice, and I understand that I'm not doing this by myself."

She added that since she decided to appeal against her conviction last year, she has yet to find any reason to give up.
