Secretary for Security Chris Tang on Friday accused Radio Free Asia (RFA) of endangering national security by spreading misleading and false information in its report on the renewal of smart ID cards.
The news agency published an article accusing the government of "threatening" overseas Hongkongers, saying they could face jail if they didn't return to Hong Kong to renew their cards.
But the government said the station was confusing different laws - and those who don't renew on time will only be fined HK$5,000.
Tang said whether charges would be brought against the station would depend on the evidence.
"At first, I didn't understand why the outlet left Hong Kong [after Article 23]. Now I know why. It's because the relevant ordinance targets those endangering national security and the security of Hong Kong," he told reporters.
"But you see, what this outlet does from afar is that it uses inaccurate information, and comes up with ways to incite the people to distrust or hate the government. These are exactly the sort of potentially illegal activities that we target in safeguarding national security."
