Commissioner for Labour Sam Hui said on Saturday that 36 fixed penalties have been issued to smokers at construction sites in around two weeks.

They were the first to be caught since a complete smoking ban at construction sites took effect on July 17, with those who light up fined HK$3,000 and contractors who fail to take all reasonable steps to maintain smoke-free environments facing penalties of up to HK$400,000 .

Speaking to the media after an RTHK radio programme, Hui said inspections had since been carried out at more than 1,200 construction sites, which also include buildings where repair, renovation and maintenance work are being carried out.

Apart from levying the 36 fines, nine notices were also issued to contractors, requiring improvements.

Hui added that prosecution was also being considered against two contractors for their failure to effectively prevent workers from bringing cigarettes and lighters into work sites.

He also said the authorities are exploring the use of technologies to enhance inspection efficiency.

“We are now exploring the possibility of installing infrared application on our small unmanned aircraft, which may help us to identify possible unknown heat risks in construction sites,” Hui said.

“We are still exploring the feasibility of this technology. If it’s proven to be applicable, then we will integrate this feature in our regular enforcement exercise.”

Hui said achieving zero smoking at construction sites is a long-term goal.
